1. INTRODUCTION

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. ONCE ACCEPTED, THESE TERMS OF SERVICE, IN COMBINATION WITH OUR PRIVACY POLICY, AND DATA PROCESSING AGREEMENT, (COLLECTIVELY THE “TERMS”), BECOME A BINDING LEGAL COMMITMENT BETWEEN YOU (OR THE BUSINESS ENTITY THAT YOU REPRESENT) AND DHP MARKETING LTD AND ITS RESPECTIVE OFFICERS, DIRECTORS, SUCCESSORS AND ASSIGNS (HEREINAFTER REFERRED TO AS “BIZIVATE,” “WE” OR “US”) AND WILL GOVERN YOUR ACCESS TO AND USE OF THE PLATFORM AND ALL OTHER INTERACTIONS WITH BIZIVATE RELATED TO THE PLATFORM.

IF YOU DO NOT AGREE TO THESE TERMS, YOU SHOULD NOT ACCEPT THEM, CREATE AN ACCOUNT, OR USE THE PLATFORM. IN THE EVENT OF A CONFLICT BETWEEN THESE TERMS OF SERVICE AND THE ADDITIONAL AGREEMENTS INCORPORATED HEREIN BY REFERENCE, THESE TERMS OF SERVICE SHALL PREVAIL.

BIZIVATE RESERVES THE RIGHT TO MAKE CHANGES TO THESE TERMS AT ANY TIME. ALL CHANGES ARE EFFECTIVE IMMEDIATELY WHEN POSTED. YOUR CONTINUED USE OF THE PLATFORM FOLLOWING THE POSTING OF ANY REVISED TERMS CONSTITUTES YOUR ACCEPTANCE AND AGREEMENT TO THE UPDATED TERMS.

YOU SHOULD CONSULT A SOLICITOR FOR LEGAL ADVICE TO ENSURE YOUR USE OF THE PLATFORM COMPLIES WITH THESE TERMS AND APPLICABLE LAW.

2. USE OF PLATFORM

2.1 AGE RESTRICTIONS

You must be at least 18 years old to use our platform. By using our platform, you confirm that you meet this age requirement.

2.2 PLATFORM ACCOUNT OWNERSHIP

The individual who registers for an account is the owner of that account. If registering on behalf of a business, you confirm that you have the authority to bind the business to these terms.

2.3 INTENDED USE

You and your customers must use the platform lawfully and in accordance with these terms. You are responsible for ensuring your use and your customers' use comply with all applicable laws and regulations.

2.4 PRIVACY

By using our platform, you agree to our Privacy Policy.

2.5 LOGIN CREDENTIALS

You are responsible for maintaining the confidentiality of your login credentials and all activities that occur under your account. Notify us immediately if you suspect any unauthorised use of your account.

2.6 USE OF COMMUNICATION SERVICES

You are responsible for all communications sent through our platform, ensuring compliance with laws such as the GDPR, TCPA, and CAN-SPAM Act. Bizivate does not originate or send any communications on your behalf. You must ensure that any data collected, stored, or processed through our platform complies with GDPR requirements, including obtaining necessary consents and providing data subjects with their rights under the GDPR.

2.7 THIRD-PARTY SERVICES

Our platform may integrate with third-party services, which are subject to their own terms and conditions. We are not liable for any issues arising from third-party services.

3. PROHIBITED USES

You may not use our platform to:

  • Violate any laws or regulations.

  • Exploit or harm others.

  • Transmit unlawful or harmful content.

  • Engage in spamming or other unsolicited communications.

  • Impersonate any person or entity.

  • Interfere with the platform’s operation or security.

4. PAYMENT

4.1 FEES

Your use of the platform is subject to payment of all applicable fees. Fees are non-refundable.

4.2 PAYMENT DISPUTES

Notify us within 60 days of any disputed charges. Failure to do so waives your right to dispute the charge.

We own the platform and all related content. You are granted a limited, non-exclusive license to use the platform for its intended purpose.

5.2 TRADEMARKS

Our trademarks may not be used without our written permission.

6. USER CONTRIBUTIONS

You retain ownership of any content you post on the platform but grant us a license to use it. We reserve the right to remove any content that violates these terms.

7. TERMINATION

We reserve the right to suspend or terminate your access to the platform at our discretion, particularly if you violate these terms.

8. CHANGES TO TERMS

We may update these terms from time to time. Continued use of the platform constitutes acceptance of the updated terms.
